high interest on the smoking restriction in a public space, became a health minister. At the same time, a
bureaucrat in the Department of Health, Labor and Welfare proposed details of smoking ban. They presented
a draught permitted a public space is divided into smoking and smoking. Although it is general to achieve the
complete non-smoking in the workplace, if it is difficult, offices and factories is allowed to smoke in a well-
ventilated room for smokers, based on the concentration of airborne dust in the device. Furthermore,
a government likely assists to some of the cost in installing a smoking room. This means all taxpayers are
obligated to provide a necessary fund for the space, that is clearly hazardous to human health. A revised
'Industrial Safety and Health Law' will be discussed in the Diet in coming autumn, hoping to be effective from
2012.

Despite the Government's announcement to declare to adopt a total smoking ban in a public space in early
2010, a study group of Department of Health, Labor and Welfare discussed about the indoor space to divide
into the non-smoking and smoking. Unfortunately, no progress was observed since the Kanagawa ordinance
that authorized a system, providinga smoking room in a restaurant and pub house, in which a waiter and
waitress work. The Japanese government has ratified, defines a framework for tobacco control with protection
from toxic tobacco smoke in the Convention, which defined a dead line of February 2010.

Since Japan is a member of the international community and comply with it, the government has the
responsibility to protect citizen's health. There is no safety level in tobacco smoke. The rule to admit a low
concentration of side-smoke from cigarette is a clearly wrong law. Under a system of designated smoking
areas, smokers, each other harm themselves, by aspirating secondhand smoke, and a worker who enters
a smoking space may inhale a cancer-producing dust. To avoid these adverse effects, the only solution is
the total smoking ban indoor, without exception.

Since 2006, I visited Europe, Oceania, and Asian countries, to examine the society, in which smoking
regulations have been in practice. The reports were widely distributedin languages of English and Japanese,
under the name of 'SmokefreeToyo'. Today, the indoor spaces of the advanced countries are in the complete
non-smoking. Government buildings, offices, railways, hospitals, restaurants, cafes, and hotel lobby and
hallways are completely smoke-free, and this regulation is well maintained. The majority of people are
supporting the indoor smoking restriction.

President Obama, who was smoking, passed the bill to strengthen the federal power to cigarettes and tobacco
product. It is your turn, Prime minister and smoker, Mr. Noda. You are expected to change and convert the
tobacco policy, that the Liberal Democratic Party preserved for more than fifty-five years.

In March, 2012, at the House of Councilors, Prime Minister Noda answered to a question about his status of
smoking. He said he has been smoking since age of 18. However, he also added that he thought about the
other people not to breathe in a second-hand smoke. He soon recognized, because of noise in the room, that
smoking at the age of 18 is against the law, and without color, retrieved in a fluster, his starting age of
smoking to be 20.- The answer in the Diet

He said that he would resign as president of the Democratic Party of Japan (DPJ) to take responsibility for his
parties crushing defeat in the House of Representatives election. ''It was a tough result for the DPJ. It was the
people's judgment, and I accept it solemnly," he said at a news conference. ''I bear the greatest share of the
responsibility. Noda said his party could not respond to the strong expectations of those who voted for DPJ
candidates in the 2009 general election, and helped bring about a change of government.

「世界から大きく乖離した日本の受動喫煙防止対策」

英国で発行されている権威ある学術誌「ランセット」に「喫煙規制制度不在の日本の、今後の平均寿命は今の水準を維持する
ことが出来ず短くなる」との論文が発表された。そうしたなか、9月には公共空間での禁煙制度に高い関心を持つ小宮山氏が
厚生労働大臣の座についた。また所轄省庁からは「受動喫煙対策」として室内空間を、喫煙容認と喫煙禁止とに分割する素案が
提示された。

目的は職場の受動喫煙対策を強化するためで、一般の事業所や工場では「全面禁煙」か、一定の条件を満たす喫煙室以外での
喫煙を認めない「空間分煙」を義務付けたものである。客が喫煙する飲食店やホテルなどで対応が困難な場合は、換気設備の
設置で浮遊粉じん濃度を基準以下にするなどの代替措置を認めるという。しかも国は喫煙室設置にかかる費用の一部を補助する
そうだ。つまり、国民の税金で健康に有害な喫煙空間を整備しようとしている。秋の臨時国会に労働安全衛生法の改正案を
提案し来年度中の施行したい考えだ。

2010年2月に政府から公共的施設内の全面禁煙の通知が出されていたが、いったいあれは何だったのだろう。当時、厚生
労働省の研究会では今回発表されたものと全く同じ議論が交わされていた。それ以降、国の喫煙規制議論には何の進展もなく、
世界の流れに逆らって分煙体制を公認した神奈川県条例から一歩も踏み出していない。

日本政府も批准している、タバコ有害煙からの保護を規定したタバコ規制枠組み条約では、2010年2月までに公共的室内空間を
全面禁煙とすることを定めている。日本は国際社会の一員として当然、これを遵守して、自国民の健康を守る責務がある。
受動喫煙には安全な量はない。濃度規制など、もってのほかである。分煙制度下では喫煙空間にいる喫煙者同士がタバコ
副流煙を相互に吸い込み健康を阻害する。また喫煙空間に出入りする従業員に発がん物質を吸入させ、人の体に多大の悪影響を
もたらす。それを回避するには例外なき屋内全面禁煙しかない。

私は2006年以来、欧米、オセアニア、アジア諸国を歴訪し、喫煙規制の実態をこの目で確認してきた。その結果を英文、和文で
発信している。今、先進国は完全な屋内全面禁煙体制に入っており、官公庁、鉄道、病院、レストラン、カフェ、ホテルロビー
や廊下などに全面禁煙規制が敷かれている。そして国民の大多数はそれを支持している。

喫煙者であったオバマ大統領はタバコの販売や広告などを規制する「タバコ規制法」を可決させた。今度は喫煙者、野田首相は
自民党が守り抜いて来たタバコ行政を大きく転換し、屋内全面禁煙制度に向け一歩踏み出す時である。

2012年3月9日の参院決算委員会で野田首相が「私、18歳からずっとやめたことなく貫いてきてしまいました。受動喫煙には
気を付けたい」と答弁した。法律で禁じられている未成年喫煙を「告白」し、慌てて訂正する場面あった。 公明党の松あきら氏
が首相に 「率先垂範して禁煙宣言してはどうか」と迫った。これに対し、首相は 「いや、参りましたね。喫煙率が下がって
いくことは望ましいと思いますが」と答えたものの、場内がざわめき、問題発言をしたことに気付いた首相は、 青ざめた表情で
「あ、すみません、20歳からです」と訂正した。

民主党大敗


2012年の衆議院総選挙で民主党およびその離党者たちは国民の強い批判を受けて大敗した。民主党は改選前の230人から57人と、
4分の1に減少、民主党を分裂させ離党者を集めた小沢一派の未来党は9人と惨敗した。自民党政権に拒否反応を示した国民が、
今回は何も、大幅な改革を実行することのなかった民主党政権を見限った結果である。特にタバコ規制に関しては、タバコ事業法
の廃止、タバコ規制を公約しておきながら、鳩山首相、管首相、野田首相をはじめ、歴代厚生労働大臣らは、タバコ値上げに
関する事項に対してのみ提言、発言があったものの、国レベルでの受動喫煙防止法については一切発言はなく、分煙容認、喫煙室
設置への補助、タバコ濃度規制に関する政策を通知するに留まった。今、世界では「屋内空間の全面禁煙」が常識化している中、
自国内でしか通用しない方針を良しとしていた。しかし、タバコ会社との関係の深い自民党政権下では、民主党より前進した
タバコ関連政策は、残念なことであるが、あまり期待することはできない。
