A total smoking ban on restaurants and bars

Since August 2007, smoking in hospitality facilities, restaurants, bars, clubs, public transport, and all private
and public workplaces has been restricted. Exemptions to the law are bars with a floor space less than 40 sqm
and offices only used by a single employee. Separate smoking rooms are allowed in hospitality facilities as
long as no food or beverage is served there.

The smoking rate in female of Denmark is reported as 23%. This relatively high rate would have an adverse
effect on the fetus during pregnancy and for an infant care.

Choice becomes first Scandinavian smoke free hotel chain.

In January 2007, Choice Hotels ASA becomes the first Scandinavian smoke-free hotel chain. 5,500 smoke
rooms are these days made ready as non-smoking rooms. All the 23,000 choice rooms in Choice 152
Scandinavian hotels will be smoke-free. In a survey conducted among Choice, guests more than 80 percent
want completely non-smoking hotels. We want to offer our guests a guest facility eliminating a tobacco
hazard and our employers a working environment in which prohibits smoking. Choice has removed the
opportunity to book smoke rooms from their web page. Demand for smoke rooms is almost zero.

All Choice Hotels in Scandinavian countries are smoke-free. No one can smoke inside of hotels. The first Grand Hotel
in Odense has 20 smoking guest rooms,
which consists of 15.6% of total 128. The ScandicHotel Copenhagen has 84 smoking rooms of total 486 rooms.
The percentage is 17.2%. Smoking rooms
in this hotel are located on the 3rd, 13th and 16th floor.

Smoking Ban in Public Indoor Areas

After August, 2007, no smoking is permitted in public indoor areas, unless a smoking device such
as a smokers' room or smokers' booth has been installed, or the area is used by one person at
a time. Food and beverage must not be served or brought into the smokers' room or booth.
Smoking in bars and cafes with an alcohol license is allowed only if the area occupied by the
premises is less than 40 square meters. Food as such must not be served.

Whether smoking is allowed in hotel rooms used for sleeping depends on the hotel management.
Smoking is not allowed in taxis or in public means of transportation.
Nearly a quarter of people in this country of 5.4 million is exposed to a passive smoking, according
to the National Board of Health. The board said a second-hand smoking was responsible for the
deaths of many people in Denmark and the hospitalization of more than 1,000 each year.

Employees or restaurants that violate the ban can be fined. First time offenders face thefine of
2,000 kroner($367). The second time, the penalty is 5,000 kroner ($913), the third time, 10,000
kroner ($1,830)

デンマークはバルト海と北海との挟まれたユトランド半島と周辺の島が国の大半を占める。北は海を挟んで
ノルウェー、スウェーデンと隣接し、南はドイツと国境を分かち合う。人口は550万人ほど、首都は
コペンハーゲンである。

デンマークはスモーカーが多いため癌（がん）死亡率は西ヨーロッパで最高である。そのうちで肺癌がもっとも
多い。政府は禁煙条例の主要な目的は国民が自分の意志に反し、タバコの先から放散される有害煙を吸わされ、
病気の発症を防止するためと述べている。

2007年8月、デンマークで喫煙規制法が実施された。この規制により、タクシー、バス、空港、スウェーデン、
イタリアへの国際列車などが全面禁煙となった。原則的にすべての公共施設、屋内職場、劇場、バー、カフェ、
レストラン、ナイトクラブなどが全面禁煙となった。教育施設では屋内喫煙所は許可されていない模様である。
食事を出さない小規模（40sqm 以下）のバーは規制法から除外された。レストラン、バーでは完全に分離した
喫煙ルーム、またはブースを設置出来る。しかし、この例外処置に関しては、議会で議論が分かれたようで
ある。

各店舗は入口に喫煙できる場所があるか、全面禁煙であるかを表示せねばならない。屋外の喫煙所は出入口
から離れたところに設置する。2008年1月から’smoke police' による取り締まりを行う。違反例に対する
罰金は2,000 ＤＫＫ（266ＥＵＲ）で、再犯した場合はその額は5,000 ＤＫＫとなる。

それから１年、今はどのようになっているのだろうかその実態を検証するためにレンターカーで各地を
回ってみたレストラン、バーでは完全に分離した喫煙室を設けることが許されたが、今回は、そうした喫煙
出来る飲食店を見つけ出すことが出来なかった。レストラン、バーの室内は全面禁煙となっていたが、禁煙
標識は非常に少ない。屋外喫煙所は出入口から離れた場所に設置するようなデンマーク規制法の条文があった
が、ホテルやファミリーレストランなどで、この規制はあまり守られていないようだ。米国のハワイ州、
メイン州などのように法律で出入口や窓から何メートルと具体的な規制を設けていないため、実態は、
屋外規制に関しては条例はあってもなくとも同じことのようだ。ただ、デンマークでは2010年には喫煙
規制法新法が出来るので、そのときに改訂される可能性はある。

OECD★の統計によればデンマークでの喫煙率は男性29％、女性23％となっているが、若い世代に限れば、
スェーデンのように女性の喫煙者の方が多いように思われる。鉄道駅のホームでも街中でも、女性喫煙者の
姿が非常に目立っていた。タバコを吸うことによって自らの老化を招くことを自覚せず、自分はまだ20代、
30代なのでタバコの害は受けないと信じているのだろうか。子供を産み育てる世代の喫煙行為は、やがて
子供たちへの潜在的影響を与えるだけに、誠に嘆かわしい現象である。

スカンディナビアのチョイスホテルグループ（コンフォート、クオリティ、クラリオンホテル）は2007年
1月より全室禁煙とした。喫煙室は全室廃止し、現在、100％スモークフリーである。ホテルマネージャーは、
この決定はホテル宿泊客、ホテル従業員のためであり、ネット上の宿泊予約で喫煙室を要望する客はほぼ
ゼロであると述べている。デンマーク、オーデンセのファースト・グランド・ホテルでは全室128室のうち、
喫煙客室は20、その割合は15.6％である。コペンハーゲンのスカンディック・コペンハゲンは全室486室の
うち、84室が喫煙客室であり、3階、13階、16階に分布している。その割合は17.2％で、自己ホテルの
ウェブサイトの表示より少ない。これは喫煙客室の数を縮小した結果と思われる。
