Smoking ban in public places in South America

世界的な公共的施設での喫煙規制の潮流の中、南米でも少しづつ、法律による全面禁煙への
道筋がつけられようとしている。

A total smoking ban in Uruguay ウルグァイ

Uruguay was the first country in Latin America to ban smoking in enclosed public spaces. Smoking in
Uruguay in public spaces became illegal in March 2006. Now bars, restaurants or offices where people
are caught smoking face fines of more than $1,100 or a three-day closure.

2006年3月、ウルグァイは南米で最初の屋内公共機関、飲食店での全面禁煙を実施した。すべての屋内における
職場、レストラン、カフェはスモークフリーとなった。違反に対する罰金は最高、1,000ドルである。


Republica de Chile チリ

チリでは喫煙者が国民の42％に達すると推定されているが、タバコに関連している死者は、少なくとも
14,000人に及ぶとされ、公共的施設の喫煙規制に踏み切った。2008年5月禁煙法が発効した。この法律のもと、
教育機関、医療機関、政府公共機関などの全面禁煙が決定した。飲食店については喫煙スペースを設けること
が認められ、完全禁煙ではない。なお、喫煙スペースに関しては政府の基準を満たした排煙装置の設置が
義務づけられる。100平方メートル以下の小規模の飲食店は規制から除外された。違反例に対する
罰金は30〜60ドルと設定されている。


Smoking ban in public places in Brazil ブラジル

Sao Paulo, the most important Latin American state in economic terms, became the first in Brazil to adopt
the complete smoke free law, being followed by Rio de Janeiro. Under the new regulation, there will not be
a smoking section in any place around the state. The ordinance will become effective from August 2009
with smoking forbidden in all indoor and enclosed public spaces such as bars and restaurants, clubs,
shopping malls, movie theaters, banks, supermarkets, bakeries, health facilities, government offices and
schools.

Sao Paulo's government has raised 500 specialized agents to make sure the rule is respected at all times.
The first team trained to warn smokers about the risk for their health.

As soon as the new law becomes effective, anybody violating it will be charged with a fine. Public sites can be
punished with a maximum fine of R $ 1,585,00 ( Brazilian currency ). If there is a second infraction, the site
will be closed. Poll surveys showed the 88% of residents in Sao Paulo support the Smoke Free Law.

ブラジル議会は2009年4月、公共的施設の閉鎖空間内での喫煙を禁止する法案を賛成、69票、反対、18票で可決した。
サンプロ市で既に実施していた受動喫煙防止法をさらに厳格化したもので、屋内でタバコが吸えるのは自宅だけと
なった。違反した場合、喫煙者に罰金はないようだが、施設責任者には罰金が科せられる。

タバコの価格は2009年5月から20％以上値上げされる。ダンヒル・カートンの価格は3.60レアルから4.50レアルへ、
マールボーロが3.40レアルから4.25レアルに上がる（１リアルは約45円）。

Republica Argentina アルゼンチン

2006年11月、アルゼンチンでは首都、ブエノスアイレス市でレストランおよびバーに於ける喫煙行為を禁止した。
しかし禁煙規制は国全体をカバーするものではない。


Republica de Colombia コロンビア

2007年1月、コロンビア都市圏での受動喫煙防止法が施行された。レストラン、バー、医療施設、市の所有する
建物などの公共的施設が含まれる。屋外席（patios ）やホテルの喫煙客室は規制から除外される。違反に対しては
最大、200ドルの罰金が科せられる。★

★2008年12月、受動喫煙防止法の施行されているコロンビアの首都、ボゴタ繁華街のバーで店内でタバコを吸っていた客に対し、
店主がウエイターに注意させたところ、犯人に店の外で刺され搬送された病院で死亡した。


Republica de Cuba キューバ

カリブ海諸国ではキューバが屋内公共施設の全面禁煙を実施し、タバコ自動販売機は撤去された。


Puerto Rico プエルトリコ

2007年3月、米国自治領のプエルトリコで公共施設や13歳以下の子供の乗車する車内を禁煙とした。
レストラン、バー、パブ、カジノ、職場を全面禁煙としている。

The most recent law is the Caribbean's toughest anti-smoking law, established in March 2007, amended
the restrictions, that forbids this practice inside jails, pubs, restaurants,, bars, casinos, workplaces,
educational institutions, cars with children under age 13. Smoking sections are not allowed. Fines start
at $250.
