South Australia

Smoking is responsible for around 1100 deaths in South Australia each year, and is the leading
cause of preventive disease and death. The adverse effect of smoking put a tremendous burden
on the health system. Breathing in second-hand smoke can particularly affect vulnerable individuals
such as young children, pregnant women and people who suffer from respiratory conditions.
A total enclosed public place smoking ban was introduced in South Australia in November 2007.
Effective in May 2010, smoking will be banned on the grounds of all public hospitals.

There was a sign board that 'You are entering a fresh air area', although, the smoking and nonsmoking spaces
are not completely separated, often seen in Japanese shops. This undesired condition was dissolved after the 2007 anti-smoking law.

In Australia, all states and territories retain exemptions from smoking bans for private rooms in sleeping
accommodation, including hotels and motels. In NSW Australia, in the year of 2005, a smoking room or
area in hotels,nightclubs and clubs must not exceed 50% of the total space, according to the smokefree
environment act of 2000. However, after 2006, the percentage of smoking room or area in hotels has been
changed not to be exceed 25% of the total space. Several international hotel chains have announced that
they will no longer allow smoking even in private rooms and have elected to be entirely smokefree.

1977年、サウスオーストラリア州では屋内の公共空間、職場、用の場所における喫煙が禁止された。
しかし、禁煙法を成立させる時点で、酒を提供するバーやカジノなどの業者からかなりの抵抗が
あったようで、骨抜きと言うべきであろうが、酒類を提供する施設では喫煙が許されるなど、
一時的に適用を除外されている場所が多く見られた。バーの面積の少なくとも50％は禁煙としな
ければならないとしたためか、非常に奇妙な表示も見られた。「バーカウンターから１メートル
以内は喫煙禁止」の標識である。バーテンをタバコ副流煙から守るための規制だが、有害煙は同じ
部屋のどこからも漂ってくるので、全く無意味な規制である。日本の飲食店でよく見かける「禁煙席」
と「喫煙席」とが混在する形式である。東京、市ヶ谷の寿司店で「カウンター席のみ禁煙」と表示
しているが、１メートル先のイス席から発癌性を持ったガス状の有害煙が流れて来る。こうした今の
日本で疑問なく横行していることが、1997年のオーストラリアで法案化されていたのだ。大きな
違いは、その時点でレストラン内では全面禁煙が強制されたことだ。

宿泊したグレネルグのStamford Grand Adeladeは11階建ての代表的なホテルであるが、8階のみが
smoking room で、これを除いた3階から11階までがnonsmoking roomとなっている。喫煙出来る
ゲストルームの割合は約11％である。アデレード市内中心部にあるHilton Adelaideは18階建てで、
そのうち６階全フロアと14階フロアの半分（50％）が喫煙フロアとなっている。6階ではタバコの悪臭
が部屋の外までもれ、通路にひどい悪臭がたちこめていた。喫煙出来るゲストルームの割合は9％強である。

日本の健康増進法よりはまだましだが、こうしたザル法は2007年10月に終結する。新しい喫煙規制は
翌月から施行され、サウスオーストラリア州ホテルのすべての喫煙ゲストルームは廃止され、ホテル
内部はバーを含め、全面禁煙となる。ヒルトンホテルの係員は全面禁煙を歓迎していたが、喫煙者の
苦情にどう対応するか苦慮しているようであった。しかし、これで10年間続いた時限的例外規定は
消滅し、バーでにおける矛盾点が解消される。今後、レストラン、バー、すべての飲食店で喫煙する
行為は不可能となる。2006年に一足早く規制を強化したクイーンズランド州内では、Mercure Hotel
Brisbaneのように、ホテル内の喫煙ルームを可としている。2007年11月に適応されるサウス
オーストラリア州の新禁煙法は喫煙ルームを全く認めないのか明確でないが、全館禁煙としたホテルは
少なくない。
